Wisconsin Legislature Approves Bill Banning PLA Mandates

On March 9, the Wisconsin State Assembly approved SB3, which prohibits government-mandated project agreements (PLA) on state and local construction contracts.  The Assembly voted 64-25 to concur on the bill, following the Wisconsin State Senate’s passage of the measure by a vote of 19-13  in February. Both votes occurred along party lines.  

“On behalf of our 850-member firms, I would like to thank the Wisconsin Assembly for concurring on Senate Bill 3, the pro-worker, Project Labor Agreement Neutrality bill. Our association stands with any measure that encourages open competition for contractors and workers,” said ABC of Wisconsin Chapter President John Mielke.  “It’s important to point out that the measure does not preclude the state or local governments from using project labor agreements to meet the highest of construction standards. It simply prohibits governmental officials from mandating workers on publicly-funded projects be represented by organized labor. The free-enterprise measure prohibits discrimination against 8 in 10 skilled tradesmen and tradeswomen who choose not to belong to unions. This includes veterans and minorities who will be able to apply their skills on public works projects funded with their own tax dollars.”

The action follows significant labor reforms that have occurred in the state in recent years. In 2015, Wisconsin became a Right to Work state and repealed prevailing wage requirements on all Wisconsin public works projects, except those built by the state of Wisconsin and state highway projects. Governor Walker is expected to SB3  bill into law later this month, which will make Wisconsin the 23rd state to enact a measure ensuring government neutrality in contracting. Twenty other states have taken action since 2009, when President Obama issued his pro-PLA Executive Order 13502. EO 13502 encourages federal agencies to mandate the use of PLAs on large-scale federal construction projects and federally assisted contracts procured by state and local governments.  

In November 2016, ABC released its latest Merit Shop Scorecard rankings;  plagued in part by its failure to adopt a government neutrality in contracting law to date, Wisconsin’s business environment ranked 21st in the country. The meritshopscorecard.org website reviews state-specific policies and information significant to the success of the commercial and industrial construction industry. Specifically, the scorecard grades states on their Right to Work status, policies on prevailing wage and PLA mandates, their construction job growth rate, commitment to developing a well-trained workforce, career and technical education (CTE) opportunities and results, and use of public-private partnerships (P3s).

Congress Votes to Permanently Block Illegal ‘Blacklisting’ Rule

ABC applauded the U.S. Senate for joining the U.S. House of Representatives in passing legislation (H.J. Res. 37) that will block implementation of the Obama administration’s controversial Fair Pay and Safe Workplaces Executive Order 13673, commonly referred to as “blacklisting,” through the Congressional Review Act (CRA). The Senate passed the measure on March 6 by a vote of 49-48.

“Associated Builders and Contractors commends Congress for taking action to free the contracting community and taxpayers from the disastrous effects of the Obama administration’s illegal blacklisting rule,” said ABC Vice President of Regulatory, Labor and State Affairs Ben Brubeck. “Since first proposed as an executive order, ABC has led the fight against this policy—which a U.S. District Court correctly ruled would violate federal contractors’ due process rights by treating non-adjudicated and often nefarious and frivolous per-adjudicated claims of violations the same as actual wrongdoing.

“By using the Congressional Review Act to nullify this rule, Congress has taken an important step in removing burdensome and duplicative reporting requirements and eliminating a costly barrier to entry that would have discouraged many small contractors from bidding on government contracts,” said Brubeck. “ABC looks forward to working with the Trump administration and Congress to improve the federal government’s existing suspension and debarment system, which already requires contractors to report violations, as well as to ensure contracts are bid through a process that encourages competition from all qualified contractors while protecting the American workforce and taxpayers’ investment.”

Implementation of the blacklisting rule’s reporting and disclosure requirements was temporarily blocked on Oct. 24, 2016, when a U.S. District Court judge for the Eastern District of Texas ruled in favor of ABC’s lawsuit and granted a preliminary injunction against the reporting provisions of the rule, which were scheduled to take effect Oct. 25, 2016. Under the CRA, Congress may pass a resolution of disapproval to prohibit a federal agency from implementing a rule without congressional authorization with a majority vote in both houses of Congresses. The U.S. House of Representatives approved H.J. Res. 37 on Feb. 2 with a bipartisan vote of 236-187.

If President Trump signs the CRA resolution into law, which a Feb. 1 Statement of Administration Policy issued by the White House signaled he will, it will block the blacklisting rule from taking effect and prevent future administrations from promulgating a similar rule—essentially permanently eliminating the rule.

According to a September 2016 survey of ABC members:

  • 51 percent said the rule’s onerous requirements, including reporting alleged violations that firms are still contesting, will force them to abandon the pursuit of federal contracts;
  • 91 percent said the rule will impose a significant or extreme burden for their firm through new requirements to compile information needed to comply with the final rule;
  • 93 percent said the final rule will make the contracting process less efficient; and
  • 98 percent said the final rule will make the contracting process more expensive.

In addition to its lawsuit, ABC has consistently opposed the blacklisting proposal since the White House issued the Fair Pay and Workplaces Executive Order 13673 in July 2014, and has:

  • Supported legislative efforts to protect contractors from the policy;
  • Submitted comments in August 2015 urging the withdrawal of the Federal Acquisition Regulatory Council and U.S. Department of Labor (DOL) proposals along with more than 300 ABC member companies;
  • Joined 19 other business trade groups in sending a Nov. 6, 2014 letter to DOL Secretary Thomas Perez and Director of the White House Domestic Policy Council Cecilia Muñoz requesting the president withdraw the executive order; and
  • Spoken out against the executive order in an Oct. 13, 2014, White House listening session hosted by Secretary Perez, Director Muñoz and Beth Cobert, deputy director at the U.S. Office of Management and Budget.

President Trump Issues Executive Order to Rein In Overreaching Waters of the U.S. Rule

ABC praised President Trump for issuing an executive order requiring the U.S. Environmental Protection Agency (EPA) to revise the controversial Waters of the U.S. (WOTUS) rule on Feb. 28. The rule had been previously been blocked under a nationwide stay issued by the U.S. Court of Appeals for the Sixth Circuit.

“Associated Builders and Contractors applauds President Trump for taking action to clarify the limits of federal jurisdiction over waterways and take steps to alleviate the current environment of regulatory uncertainty plaguing contractors,” said ABC Vice President of Legislative and Political Affairs Kristen Swearingen. “The overreaching rule crafted by the Obama administration’s Environmental Protection Agency would have stymied growth in the construction industry and needlessly delayed projects via a lengthy permitting process.”

House Passes Legislation to Block OSHA’s “Volks” Rule

The U.S. House of Representatives passed legislation to block implementation of the Occupational Safety and Health Administration’s (OSHA) “Volks” final rule through the Congressional Review Act (CRA). The bill (H. J. Res. 83) was passed in a bi-partisan vote of 231-191.

Also known as Clarification of an Employer’s Continuing Obligation to Make and Maintain an Accurate Record of Each Recordable Injury and Illness, the final rule extends the time period in which an employer may be cited by OSHA for recordkeeping violations from six months to up to five years. The rulemaking reverses the U.S. Court of Appeals for the District of Columbia Circuit’s decision in AKM LLC d/b/a Volks Constructors v. Sec’y of Labor, which stated that OSHA must stick to a six-month statute of limitations when citing a company for failure to record an injury or illness and cannot treat such an event as a continuing violation throughout the five-year recordkeeping period. The final rule went into effect Jan. 18, 2017.

Ahead of the vote, ABC sent a letter to members of the U.S. House of Representatives urging them to support the resolution. In the letter, ABC explained, “ABC members understand that safety and health practices are inherently good for business; however, this rulemaking does nothing to improve workplace safety and is simply a paperwork burden. OSHA’s promulgation of this rulemaking is a clear overstepping of its authority and a contradiction of the OSH Act and U.S. Court of Appeals decisions.”

ABC also sent a letter to House leadership as a member of the Coalition for Workplace Safety urging them to move forward with the resolution.

The resolution of disapproval now awaits action in the U.S. Senate. If it is successful in the Senate, the resolution will be sent to President Trump, whose signature would kill the rule and prevent a future administration from issuing a similar regulation.

New ABC Diversity Website Goes Live

ABC’s membership strategy is to continuously grow and deliver value to a diverse and committed membership. To help with this effort, ABC launched its new diversity page during the association’s Workforce Week ’17 Conference the week of Feb. 27. The page features information on Diversity Resource Groups (DRGs), the Diversity and Inclusion Summit and ABC’s Diversity and Inclusion Awards.

DRGs
DRGs are voluntary associations of people who have common interests, which may center on race/ethnicity, gender, etc. These groups can play a vital role in articulating, promoting and supporting the needs and goals of their various constituencies. The new ABC DRGs website aims to convey helpful information to anybody interested in learning more about diversity in the construction industry.

The main functions of the DRGs are:

  • Solicit input on how ABC can create value
  • Solicit input on topics for the Diversity & Inclusion Summit
  • Promote the Diversity Awards
  • Recruit MBE firms into ABC

Diversity & Inclusion Summit
ABC’s Diversity & Inclusion Summit is a gathering of industry leaders and key stakeholders who understand the value of supplier diversity in construction and whose goal is to help promote the association’s mission within diverse groups.

ABC will host its third annual Diversity & Summit on June 19 during its Legislative Week conference.

ABC Celebrates, Collaborates and Connects at Workforce Week ‘17

Associated Builders and Contractors (ABC) announced the winners of the National Craft Championships, the 2016 National Safety Awards, the National Diversity Excellence Awards and the Excellence in Construction® Awards during its annual conference Workforce Week ’17 in Fort Lauderdale, Fla.

Workforce Week is ABC’s annual celebration of the best in merit shop construction, recognizing the contributions of members, chapters and craft professionals to the construction industry and their dedication to excellence.

ABC Congratulates 2017 National Craft Champions
ABC announced the winners of the 30th annual National Craft Championships (NCC) during its Careers in Construction awards ceremony on March 3 at the conclusion of ABC’s Workforce Week ’17.

“This year’s field of the top construction apprentices and trainees truly represents the very best the merit shop construction industry has to offer, and Associated Builders and Contractors could not be more proud of these talented men and women,” said 2017 ABC National Chair Chuck Goodrich, president of Gaylor Electric, Indianapolis. “Gaylor Electric and our fellow ABC member companies are truly fortunate to employ such a talented group of highly trained and incredibly skilled craft professionals who represent the future of our great industry.”

This year’s field of competitors featured nearly 170 craft professionals from 28 states competing for top honors in 13 competitions across 11 crafts. Competitors first took an intense, two-hour written exam and then competed in a daylong hands-on practical performance test. Cash prizes were awarded to medal winners with gold medal winners taking home $750, silver medal winners earning $500 and bronze medal winners receiving $350.

Excellence in Construction® Awards

2017 National Craft Championships Winners Announced

ABC congratulated the winners of its 30th annual National Craft Championships competition during the March 3 Careers in Constructions awards held during the association’s Workforce Week Conference, Feb, 28-March 3, in Fort Lauderdale, Fla.
